“My Kissimmee Story” Sweepstakes Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.  MAKING A PURCHASE DOES NOT INCREASE CHANCES OF WINNING.

The following promotion is intended for participants in the fifty (50) United States and Washington, D.C. only and shall be construed and evaluated according to the laws of the United States. Do not proceed in this promotion if you are not a legal resident of one of the fifty (50) United States or Washington, D.C. or not currently located in one of the fifty (50) United States or Washington, D.C. Further eligibility restrictions are contained in the official rules below.

1. DESCRIPTION:  NO PURCHASE NECESSARY TO ENTER OR WIN. The “My Kissimmee Story” Sweepstakes (“Sweepstakes“) begins on Tuesday, June 21, 2011 at 12:01 am Eastern Standard Time (“EST“) and ends on Monday, September 12, 2011 at 11:59 pm EST (“Sweepstakes Period“).  The Sweepstakes Period consists of twelve (12) separate “Weekly Drawings” in which one (1) “Weekly Prize Winner” will be selected from among all eligible entries received during each “Weekly Entry Period.”  Weekly Entry Periods begin each Tuesday during the Sweepstakes Period at 12:00 a.m. EST and end each Monday at 11:59 p.m. EST.  Non-winning weekly entries WILL NOT be rolled over into subsequent Weekly Drawings.  The sponsor of this Sweepstakes is Kissimmee Convention and Visitors Bureau (“Sponsor”).  The administrator of this Sweepstakes is Creative Zing Promotion Group (“Administrator“).

2. ELIGIBILITY: This Sweepstakes is open only to legal residents of the fifty (50) Unites States or the District of Columbia, who are physically located and residing therein and who are at least 18 years of age and the age of majority in their state of primary residence at the time of entry (“Entrant”).  Employees of Sponsor,  Administrator, their advertising or promotion agencies, those involved in the production, development, implementation or handling of this Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, prize suppliers and fulfillment companies, any other person or entity associated with this Sweepstakes (collectively, the “Sweepstakes Entities“) are ineligible to enter or win this Sweepstakes. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses.  Void in Alaska, Hawaii and where prohibited or restricted by law.

3.  HOW TO ENTER: Entrants may participate by logging onto the Sweepstakes Web site located at www.MyKissimmeeStory.com  (“Web site“).  Entrants must follow the on-screen instructions to submit entrant’s Kissimmee story (the “Story”) and optional photo(s) and or video (collectively, with the Story, the “Entry Materials”). Entrants must then follow the on-screen instructions to complete the online entry form including, but not limited to:  name, street address, email and phone number.    The Story and Entry Materials will not be judged and have no bearing on the determination of winners.  Once the entry information is complete and all Entry Materials have been provided, Entrant must click the “Submit” button to receive one (1) entry into the corresponding Weekly Drawing. Entry is not complete until Entrant has followed the online prompts to upload their Entry Materials and affirmatively accepted the Official Rules.

Entry Material Requirements

The Entry Materials must meet the following guidelines:

• Videos must be equal to or no greater than :30 seconds and may not exceed 100 MB in file size; and must be submitted in one of the following formats: asf, .wmv, .mov, .qt, .3g2, .3gp, .3gp2, .3gpp, .gsm, .mpg, .mpeg, .mp4, .m4v, .mp4v, .cmp, .divx, .xvid, .264, .rm, .rmvb, .flv
• Photos must not exceed 1 MB in file size; and must be submitted in one of the following formats:  .jpg, .gif, .png.

The Submission must meet the following content restrictions:

• Entry Materials must NOT contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing; or material that contains any derogatory references to any Sweepstakes Entities;
• Entry Materials must be entirely original to the Entrant and must NOT include mention or performance of any copyrighted media production including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media property;
• Entry Materials must NOT have been previously submitted to another sweepstakes or contest, broadcast on a media network or submitted to any entertainment entity that would conflict with this Sweepstakes, as determined in the Sweepstakes Entities’ sole discretion;
• Entry Materials must NOT include materials that violate or infringe another person’s rights, including, but not limited to, privacy, publicity or intellectual property rights, such as copyright infringement or include third party trademarks, logos, insignia, location signage, photographs, artwork, or sculpture; and
• Entry Materials must NOT include third parties/people, who have not expressly authorized Entrant to display their image, likeness or voice in the Entry Materials or otherwise use such image, likeness or voice in accordance with these Official Rules. Third Parties include but are not limited to celebrities, friends and minors who have not obtained parental consent prior to such participation. Entrants should be able to provide on request all appropriate clearances, permissions and releases for the Entry Materials, including releases from all persons appearing in the Entry Materials and location releases for all recognizable locations (in the event an entrant cannot provide all required releases, Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify the applicable Entry Materials).

Entrants who submit Entry Materials, which violate any of these requirements, may be deemed ineligible to receive the prize and their Entry Materials may be void at the Sweepstakes Entities’ sole discretion. Sweepstakes Entities reserve the right to disqualify in their sole and absolute discretion any Entry Materials deemed inappropriate.  Incomplete or unintelligible entries will be disqualified. Sweepstakes Entities reserve the right to determine in their sole discretion which entries have satisfied the entry requirements. ELIGIBLE ENTRANTS MUST SUBMIT IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED. There will be no notification of receipt of Sweepstakes-related materials.  Assurance of delivery of Entry Materials will be the sole responsibility of the Entrant.

Limit of one (1) entry per person, per Weekly Entry Period.   Entries in excess of the limits stated herein will result in disqualification of the Entrant.   Entries generated by a macro, script or other automated means will be disqualified.  Each Entrant must be the rightful owner (or have authorized use) of the email address used for entry.  In the event of a dispute as to the identity of an online Entrant or winner, the Entrant or winner will be deemed to be the person in whose name the email account was opened.  Incomplete, unreadable, or unintelligible entries will be disqualified. Entrants must provide all information requested to be eligible to win.

4. REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Each person who enters this Sweepstakes represents and warrants as follows: (i) the Entry Materials are the entrant’s own original, previously unpublished, and previously unproduced work; (ii) the Entry Materials do not contain any computer virus, is otherwise uncorrupted, is wholly original with entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the Entry Materials do not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; and (iv) the Entry Materials do not and will not violate any applicable laws, and are not and will not be defamatory or libelous.  Each Entrant hereby agrees to indemnify and hold the Sweepstakes Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

5. GRANT OF RIGHTS: Each entrant into the Sweepstakes hereby irrevocably grants to Sponsor, its successors and assigns, the non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display the Entry Materials in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Sweepstakes and other promotions.  Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the Entry Materials for any purpose which Sponsor deems necessary or desirable, and each entrant irrevocably waives any and all so-called moral rights they may have therein.

6. PUBLICITY RELEASE: By participating in the Sweepstakes, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant or winner of the Sweepstakes, each entrant irrevocably grants without any additional compensation whatsoever,  the Sponsor and its successors, assigns and licensees, the right to use such entrant’s name, likeness, biographical information and Entry Materials in any and all media for any purpose, including without limitation, advertising and/or promotional purposes as well as in, on or in connection with the Website or the Sweepstakes or other promotions, and hereby release the Sponsor from any liability with respect thereto.

7. WINNER SELECTION AND NOTIFICATION: Potential Weekly Winners will be selected in random drawings conducted by the Administrator, on or about each Tuesday beginning June 21, 2011, from among all eligible entries received as of the end of each week during the Sweepstakes Period.  Non winning Weekly Entries WILL NOT be rolled over into subsequent Weekly Drawings.  The potential winners will be notified by telephone, email and/or overnight mail within approximately one (1) day of the aforementioned drawing date. The potential winners must be able to receive telephone calls from an unlisted and/or blocked number. Messages may not be left. Winners will be required to respond (as directed) to the notification within twenty-four (24) hours of first attempted notification. Potential Winners may be required to verify address and return within two (2) days an affidavit of eligibility, a liability release and (where imposing such condition is legal) a publicity release (collectively, the “Prize Claim Documents“). Failure of any potential winner to respond or to return the Prize Claim Documents within the specified time period may result in forfeiture of the prize and selection of an alternate winner from the remaining eligible entries for that prize. A prize will not be awarded until all such properly executed forms are returned. Winners will receive an IRS Form 1099 from the Sponsor for the total actual retail value of the Weekly Prize (stated above) in the calendar year in which the prize was fulfilled.  If prize is awarded but goes unclaimed or is forfeited by recipient, the prize may not be re-awarded, in Sponsor’s sole discretion.  Limit one (1) prize per household.

8.  ODDS OF WINNING: Odds of winning depend on the number of eligible entries received.

CONDITIONS OF PARTICIPATION/RELEASES: Sponsor, in its sole discretion, may designate the Administrator to handle winner selection, notification and fulfillments tasks on Sponsor’s behalf.  All federal, state and local laws and regulations apply. By participating, each Entrant agrees to be bound by these Official Sweepstakes Rules and the decisions of the Sweepstakes Entities, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any prize that he or she may win, each Entrant agrees to release the Sweepstakes Entities and each of their’ respective successors, employees, agents, representatives and assigns (collectively, the “Released Parties“) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of a prize. Each Entrant authorizes the Sweepstakes Entities to use his/her name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, and on a winner’s list, if applicable, without further compensation unless prohibited by law. Sweepstakes Entities are not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sweepstakes Entities sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses, liabilities or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize including participation in any activity or travel related thereto, or from participation in the Sweepstakes; (v) any inability of Winner to accept or use any prize (or portion thereof) for any reason and such prize or portion thereof shall be forfeited; or (vi) any printing, typographical, human administrative or technological errors in any materials associated with the Sweepstakes. Sweepstakes Entities disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes. Sweepstakes Entities reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes (or any portion of the Sweepstakes) should a virus, bug, computer problem, unauthorized intervention or other problem/cause corrupt or inhibit the administration, security or proper play of the Sweepstakes and, in such situation, will select the winner(s) from eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by the Sweepstakes Entities. Sweepstakes Entities may prohibit Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants or Sweepstakes Entities representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

11. DISPUTES: This Sweepstakes is governed by the laws of the United States and the State of Florida, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Osceola County, Florida . Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.

12. PRIVACY POLICY: Any personal information supplied by Entrant will be subject to Sponsor’s privacy policy posted at http://www.visitkissimmee.com/leisure/footer/privacy policy.  By entering the Sweepstakes, Entrants grant Sponsor permission to share his/her email address and any other personally identifiable information with the other Sweepstakes Entities for the purpose of administration and prize fulfillment.  Additionally, by opting-in to specific offers from any of the Sweepstakes Entities or prize providers, Entrant’s entry information will be subject to their respective privacy policies and Entrant agrees to receive additional email communication from those companies.   Sponsor will not sell, rent, transfer or otherwise disclose your personal data to any third party other than as explicitly described herein.

15.  WINNER LIST/OFFICIAL RULES: To obtain a copy of the Winners list or a copy of these Official Rules, send a request along with a stamped, self-addressed envelope to “My Kissimmee Story Sweepstakes” Winner List/Rules, The Plaza South Tower, 189 S Orange Ave, Suite 1130A, Orlando, FL 32801. Requests for the names of the winner must be received no later October 31, 2011. Vermont residents may omit return postage.
